Divorce in Colorado

Here to help guide you through this difficult time

Facing the end of a marriage can be overwhelming. Unlike getting married, divorce is not a life experience you dream of and plan for. Whether the thought of divorcing has been around for a while, or your spouse surprised you with divorce papers, it is an unexpected life experience. Even when a divorce is anticipated to be amicable, few life experiences are more stressful, emotional, or difficult than divorce. Divorce is not simply about navigating the legal process. It is an intensely personal experience, and it deeply impacts all aspects of your life.

Family Law Group has experienced attorneys who can help guide you as you navigate the divorce process. They will listen to you about your concerns and fears and help answer your questions. Your family law attorney is your advocate and can help advise you on the divorce process and how the legal system approaches issues like child custody, spousal support, division of property, handling debts, and other common issues with divorce. Your family law attorney can help you understand how to protect your interests and how to assert your rights during divorce proceedings.

We understand that legal expenses for a divorce are rarely planned for and are never convenient. We will provide you with options, advice, and strategies to balance your costs against the anticipated results. When you understand how Colorado law will likely be applied in your situation, you can make informed decisions on how to pursue your goals and desires, while avoiding the extra costs of chasing outcomes that are unlikely.

We believe in being assertive in advocating for our clients’ interests without being unnecessarily aggressive and hostile. Unwarranted aggressiveness often leads to more conflict, increased costs, and a longer divorce process.

We value the benefits of mediation and negotiated resolution. When both parties make serious efforts to come to reasonable agreements, the divorce is usually resolved faster and for lower legal fees. It also gives you the ability to negotiate and control certain aspects of the final resolution, rather than leaving these important aspects of your life, your time with your children, and your finances to be decided by a judge.

Unfortunately, if just one side is difficult or unreasonable, mediation may not result in an acceptable solution. You never have to accept a settlement offer, and sometimes the additional cost of going to trial is what you need to prevail or the other side needs to come to a reasonable settlement. If your divorce needs to be resolved through litigation, your attorney will be prepared to zealously advocate for you.

To file for divorce in Colorado, at least one party must have lived in Colorado for at least 91 days. Colorado is a “no-fault” divorce state. This means that neither party has to prove the failure of the marriage is because the other party is to blame. Only one party has to state the marriage is “irretrievably broken.”

Whether you are facing an annulment, legal separation, or friendly or hostile divorce, the Colorado Springs and Woodland Park family law attorneys at Family Law Group can help.
