How to retain custody of children during Divorce

So….what happens when a heart commits a crime and is caught? Answer: Cardiac arrest. Admit it, you cracked a smile. Nearly every day my daughter sends me a dumb joke like the one above. And nearly every day I smile just a bit. I smile not so much for the joke but because for a brief moment my beloved daughter and I have connected. I love being a father and although my children are all out of the house I cannot imagine a time when I will not be their father. I worry about them, I counsel them, I listen to them, and I pray for them. They are, next to my marriage, one of the best things to ever have happened to me. I am sure those of you with children share my feelings. Consequently, when I meet with prospective clients who are caught in a divorce with children I understand that a key concern is how that person can have custody of their children or at least share custody of their kids. The key to having parenting time with your children after a divorce is to be the parent you know you need to be. That’s really it.Now I know that divorcing spouses often fight through their children; resist that temptation. Take the higher ground. Even if you have to fight for visitation doing what I suggest will pay dividends. In a recent case my client took my counsel and we blocked the other parent from leaving the state with the children, and we now have a parenting plan that is good for the kids and which reflects the involvement my client has with the kids. If my client had followed their first impulse they may very well have caused problems I could not have fixed. When you are in a custody fight know that it is not about winning a battle and that it is really about winning the war. In my last blog I wrote about the importance of getting at least some legal advice when you are faced with a divorce or other legal matter. I cannot over-emphasize the importance of doing this because a failure to do so now can cause big problems later in the future. Contact us if we can help.
